Conditions

1. Scope of application

These Terms and Conditions apply to all contracts for the sale of new and used vehicles, special parts ("HOF Special Parts"), tuning services, workshop services and accessories between HOF Automotive GmbH ("HOF") and its customers.

Deviating terms apply only with explicit consent. Dealer rules also apply where relevant.

2. Conclusion of contract

Offers are non-binding. A contract is concluded only upon written order confirmation. Withdrawal in case of non-availability remains reserved.

3. Subject matter of the contract

The subject matter of the contract includes vehicles, conversions, special parts, workshop services and accessories. Technical changes remain reserved.

4. Workshop and tuning services

The law on contracts for work and services applies. Acceptance within 7 days. Subsequent changes may result in additional costs.

5. Delivery & collection

Collection takes place at HOF’s registered office. Shipping is possible at the customer’s request. Risk transfers upon handover to the carrier.

6. Delivery times

Delivery times are binding only if confirmed in writing. Force majeure extends the deadlines.

7. Prices & payment

In EUR plus VAT, if applicable. Standard: 15% down payment, balance before handover. Consequences of default may apply.

8. Retention of title

Title remains with HOF until full payment. Extended and prolonged retention of title applies for business customers.

9. Warranty

24 months for consumers, 12 months for business customers. Shorter periods may apply for used goods. No warranty for wear and tear or improper use.

10. Warranty for HOF Special Parts

Custom solutions, no returns. Registration/approval obligations remain with the customer. Manufacturer warranties may be affected.

11. Liability

Unlimited in cases of intent and gross negligence. Limited liability in cases of slight negligence.

12. Right of withdrawal

Consumers may withdraw from the contract within 14 days without giving reasons.

Start of the period: Upon receipt of the goods.

Consequences of withdrawal:

• Refund of all payments within 14 days
• Customer bears compensation for any deterioration not attributable to inspection of the goods
• Collection is carried out by HOF

13. Dealer rules

MSRP compliance, brand guidelines, independent warranty obligations towards end customers.

14. Privacy

Data processing in accordance with GDPR. Details in our Privacy Policy.

15. Final provisions

German law applies. Place of jurisdiction is the registered office of HOF Automotive GmbH.
